Big Coal’s All Too Cozy Relationship With the W.V. Supreme Court Under Fire

A six year old West Virginia jury award now worth $70 million against the country’s fourth largest coal company was overturned last week by the West Virginia Supreme Court. Now a look back at what happened in between is raising eyebrows, not to mention Massey Energy CEO Don Blankenship’s hackles. This one seems eerily similar to John Grisham’s latest, only this is for real. ABC’s Brian Ross explains.

After Massey Energy appealed the case, its CEO Don Blankenship, a Richmond Virginia resident, helped bankroll a $3.5 million ad campaign to successfully unseat W.V. Supreme Court Justice Warren McGraw and replace him with Justice Brent Benjamin, or as fellow Justice Larry Starcher put it, “the election was bought, a seat was purchased on our Supreme Court, and I’m highly offended by it.” Then pictures surfaced of Blankenship and W.V. Supreme Court Chief Justice Spike Maynard vacationing with their girlfriends on the Riviera. “It was a trip the Chief Justice never disclosed to the court, even when he voted with the majority to overturn the huge Massey verdict, according to Justice Starcher, who is now being interviewed by the FBI.”

After the pictures became public, Justice Maynard did recuse himself, but so did fellow Justice Starcher because (gasp), he had dared to have been critical of Blankenship’s relationship with the Court. So the three remaining W.V. Justices, including Blankenship’s 3.5 million dollar Justice Benjamin, reheard the case last week and again overturned it.

When approached for a comment by ABC News, Blankenship threatened that the reporter was “liable to get shot” and attacked his camera.

W.V. Chief Justice Maynard insists he’s been the victim of “the mother of all political smears,” even after it came out that Blankenship’s chief political consultant is now helping Maynard’s re-election bid. Let’s hope that goes about as well as Blankenship’s $3 million attempt to finance a GOP takeover of the W.V. House in 2006.

American Airlines apologized to passengers for the shutdown of 1,000 flights Wednesday, and said it was offering $500 vouchers and reimbursing passengers who are stranded overnight.

Dan Garton, executive vice president of marketing, said American technicians had taken “certain latitude” two weeks ago in an initial round of inspections on the airline’s MD-80s, the workhorse of American's fleet. The FAA ordered planes grounded again for a second round of inspections Monday, saying the airline hadn’t fully complied with its directive to inspect planes for potential problems with wiring in wheel wells.

“We’re extremly sorry for this great inconvenience,” Garton said during a media briefing this afternoon. “This type of interruption is truly unacceptable.”

American is offering $500 vouchers toward future travel for anyone who is stranded overnight, Garton said. American also is reimbursing for hotels, meals, and ground transportation for passengers who are stranded overnight.

Sen. John McCain's defenders are blasting a new biography that claims the White House hopeful once hurled the most vile of epithets at his wife, Cindy.

Democratic strategist Cliff Schecter claims in "The Real McCain" that the presumptive GOP nominee uttered the shocking slur in front of aides and reporters while campaigning for the senate in 1992.

"At one point, Cindy playfully twirled McCain's hair and said, 'You're getting a little thin up there,'" Schecter writes. "McCain's face reddened, and he responded, 'At least I don't plaster on the makeup like a trollop, you [bleep].'"

McCain spokeswoman Jill Hazelbaker brands the book "trash journalism" and tells us, "The story is completely fabricated."

Schecter, who makes no bones about being partisan, writes: "McCain's excuse [for the alleged outburst] was that it had been a long day. If elected President of the United States, McCain would have many long days."

The author says he heard the story from three "reporters from Arizona," who spoke "on the condition of anonymity."

Schecter contends these reporters didn't run the story themselves because they were "squeamish" about repeating McCain's language.

The two Democrats returned to the campaign trail in Pennsylvania Wednesday, looking toward the state's April 22 primary. In making their claims at separate appearances, Clinton and Obama implicitly suggested that Sen. John McCain, the likely Republican nominee, is not up to the task of running the country.

Clinton said McCain is unwilling to withdraw troops, and Obama cannot be trusted to do so. Her comments came one day after the three candidates spent a rare day in the Senate questioning the top U.S. military commander for Iraq.

"One candidate will continue the war," she told an audience at Hopewell High School, near Pittsburgh. "One candidate only says he'll end the war. And one candidate is ready, willing and able to end the war."

Obama, campaigning in the Philadelphia suburbs, issued a broad indictment of Republican economic policies and singled out McCain for special rebuke, saying he is willing to "sit idly by" in the face of a national housing crisis.

"It's time to end the Bush-Cheney-McCain policy that tells the American people 'you're on your own' because we're all in this together," Obama told a crowd assembled at Great Valley High School in Malvern.

But Obama also tweaked Clinton, alluding to her husband's presidency while blaming Democrats for being at times "too timid" to confront Washington special interests.

"We let go of the past, but we never finished that bridge to a future of lasting prosperity," he said, a reference to the slogan President Clinton used as he began his second term of office about building a bridge to the 21st century. "Instead, we lost that common stake in each other's prosperity."

President Bush is calling on China to reach out to the Dalai Lama to find a solution to the unrest in Tibet.

Bush says "it would stand the Chinese government in good stead if they would begin a dialogue with the representatives for the Dalai Lama."

The president spoke about the civil unrest in Tibet and China's crackdown there on Wednesday with Singapore's senior minister, Goh Chok Tong. Violent clashes in Tibet are threatening to overshadow China's hosting role of the Summer Olympics in August.

Bush said Wednesday that if China's leaders ever were to reach out to Tibet's exiled spiritual leader, "they'd find him to be a really fine man, a peaceful man."

Bush has previously appealed directly to Chinese President Hu Jintao on the matter.

SAN FRANCISCO (KGO) -- The Olympic Torch relay significantly changed its route.

At this point, the torch is headed north on Van Ness toward Aquatic Park, west on Bay Street, under the Golden Gate Bridge and then will board a shuttle headed for Justin Herman Plaza.

Rolling street closures are occuring throughout the city.
For a period of time, the whereabouts of the torch were unknown although former Mayor Willie Brown told ABC7 News that it was on a bus in the city.
The torch route was significantly cut short this morning from 8 miles to 4 miles.

Why Obama Lost Massachusetts

"Together we can," was the endlessly repeated slogan of Deval Patrick, Barack Obama's close political and personal friend, as Patrick ran for governor of Massachusetts in 2006--successfully. Many of us wondered what that slogan meant, and when we displayed the Audacity of Inquiry, the Politically Correct Dems told us that it was "inspirational." In fact Patrick and Obama consult with one another on their campaigns, using the same PR firms, with Obama's Senatorial campaign slogans recycled to Patrick's gubernatorial campaign and then back again to Obama's presidential campaign. The Audacity of Repetition.

So why did Obama lose to Hillary here in Massachusetts? Governor Patrick endorsed Obama and put his highly touted, but quite invisible, "grass roots" organization at Obama's disposal. The Kennedys endorsed Obama and John Kerry also endorsed him--although the latter is actually a bit of a negative in Massachusetts where the arrogant Kerry is widely reviled. And Obama was all the rage in the PC precincts of Cambridge and Brookline. Nevertheless he lost.

One key to Obama's loss was that Hillary waltzed into the working class areas of central MA, which the tonier neighborhoods of Boston consider to be somewhere near Utah, and made her case. In central Mass if you see an antiwar sign, it is likely to bear Ron Paul's name. So Hillary campaigned in the depressed cities of Worcester and Springfield--and won. In those areas, the slogans, "Yes, we can," and "Together we can," remained a mystery. The folks there lack the Ivy education, more properly understood as a finely honed herd instinct, which it clearly takes to understand the sayings of Obama. Whether or not the working class voters of the poor cities of Massachusetts believed Hillary, at least she said something comprehensible.

But there is a bit more to the story. We here in Massachusetts have had a preview of Obama in our new governor, Deval Patrick. And what we have seen is not pretty. The first thing of note that Patrick did was to buy some very expensive new drapes for his corner office and a more expensive official vehicle --a large, handsome black Cadillac. Those news items brought snickers at the spending habits of this "man of the people." But Patrick's signature issue has been his effort to bring casino gambling to Massachusetts, the only means that Patrick could come up with to raise some badly needed revenues. Of course revenues are missing from state coffers in part because Patrick's buddy Obama is voting hundreds of billions for the war on Iraq. Patrick's proposal turned out to be very unpopular with the state legislature, and so it lost. But it was worse than that. On the day of the vote, Patrick was MIA, and it turned out he was in NYC shopping his autobiography around. He returned to find the legislators who had stuck with him left high and dry, but he had in hand a $1.3 million book contract. (Patrick concealed where he had been, but one intrepid reporter found him out.) That sure smelled bad. The joke is that at last we know what he meant with his campaign slogans: "Together we can gamble in casinos," "Si, se puede ... apostar en casinos."

Kagan’s list got distributed to “Republicans on the House Armed Services Committee” last week, House Minority Leader John Boehner (R-OH) referred to it in his Townhall.com column, Sens. James Inhofe (R-OK) and Jon Kyl (R-AZ) both cited it to reporters, and Sen. John Cornyn (R-TX) quoted it to Amb. Ryan Crocker yesterday.

But, as CQ’s Josh Rogin points out today, “Kagan’s assessment takes controversial stances, including declaring that ‘there are no safe havens in Iraq for outlaws.’” Though not responding directly to Kagan, on CNN’s The Situation Room yesterday, Michael Ware, who has reported from Iraq since before the U.S. invasion in 2003, also disputed some of Kagan’s claims to progress. “The proof has got to be in the pudding, and right now, that pudding stinks,” said Ware. Today, Sen. Bill Nelson (D-FL) held a hearing on the alleged rapes by U.S. contractors in Iraq and the lack of federal prosecutions. Dawn Leamon, who worked for KBR in Iraq and has two sons who served as soldiers, is the latest victim of sexual assault to come forward. She testified that she was “unaware of any measures to date being taken against the KBR employee or the member of the U.S. military who attacked me.” Yesterday, the Justice Department reversed course and agreed to answer Senate questions on why it has not prosecuted any of these cases.

Gordon Brown will skip Olympic opening ceremony in Beijing.
Earlier this week, British Prime Minister Gordon Brown “ruled out a boycott of the Beijing Olympics” saying that “the Dalai Lama himself has said that he does not want to see a boycott.” But the BBC is reporting today that now Brown has said will not attend the opening ceremony but is “not boycotting the Olympics and planned to attend the closing ceremony.” Just last month, German Chancellor Angela Merkel “became the first world leader to decide not to attend the Olympics in Beijing.” While President Bush has said definitively that he will attend the games, White House press secretary Dana Perino yesterday left the door open to the possibility that he will also skip the opening ceremony.

Ex-Calif. Lawmaker Jackie Speier Wins Special Election To Replace Late Tom Lantos

SACRAMENTO, Calif., April 9, 2008

(AP) Former state lawmaker Jackie Speier, a survivor of the Jonestown tragedy three decades ago, won a special congressional election to fill the seat of the late Rep. Tom Lantos.

With her win Tuesday, Speier, a Democrat, avoided a runoff in the contest to replace the 14-term congressman, who died in February. Speier, a former state assemblywoman and senator, also plans to seek a full term in 12th Congressional District later this year.

Speier, 57, had nearly 78 percent of the vote in unofficial returns. She needed more than 50 percent to avoid a June 3 runoff election. Also on the special election ballot were a fellow Democrat, two Republicans and a member of the Green Party.

In 1978, Speier was an aide to Rep. Leo Ryan and accompanied him on a mission to Guyana. The purpose was to investigate claims that Peoples Temple leader Jim Jones was holding followers against their will at the California-based group's Jonestown compound in the South American country.

An ambush at the Jonestown airstrip left Ryan and four others dead and Speier severely wounded. Jones and his followers then committed mass murder-suicide, drinking cyanide-poisoned punch. More than 900 people died, including hundreds of children.

Speier lost a special election to fill Ryan's seat in 1979 but went on to represent the area as a San Mateo County supervisor and in the state Assembly and Senate. In 2006, she narrowly lost a campaign for the Democratic nomination for lieutenant governor.

I had a question about my cat Lucy. She has been limping lately. Favouring her left leg. She lets me examine it without freaking out but she is obviously in some discomfort. However I see her jumping around and running and scratching stuff like regular with both paws, but when she is just walking she limps. Can't tell if it's just because she likes the attention or what? Should I take her to a vet? I have never had an injured cat. I am assuming you have. What should I do?

Why do Mets fans at Mets games while playing any other team except their cross town rivals have to chant "Yankees Suck" all the time? Every time the Mets score a "Yankees Suck" chant starts. Don't they know this is annoying. I assure you the Yankees crowd in the Bronx doesn't even care that there is another team in Queens unless we are playing them. Why people? Why? "Let's Go Mets" is a good chant. I would even accept "Yes We Can" since it is an election year. But "Yankees Suck" is just wrong. Please stop. Thank You.

Earlier this week, I mentioned that the conservative blog RedState is trying to pressure the traditional media to treat critiques of John McCain's embrace of a 100-year occupation of Iraq as lies and distortion.

Today, RedState sent an email alert to readers to further push the point ... making a, shall we say, novel argument (emphasis added):

Clearly McCain was talking about a peace time standing presence ... Someone should ask the Democrats if they think we're still at war with the confederacy, the Germans, and the Japanese given all the standing American armies in the South, Germany, and Japan.

As I said in my previous post, "Claiming a 100-year occupation in Iraq would be like Germany or Korea reveals an immense lack of foreign policy knowledge, judgment and vision. The situations and political dynamics have absolutely no similarity." (For more on that point, check out Agence France Presse, Coalition for a Realistic Foreign Policy, Talking Points Memo, Booman Tribune, The Newshoggers and Juan Cole.)

But hey, at least Germany and Japan are like Iraq in that they are other countries.

I can't believe I am wasting 15 seconds of my life to type this, but having military bases in Alabama, Georgia and South Carolina does not constitute a permanent occupation. Does RedState really believe that 140 years after the Civil War, American troops have a "peace time standing presence" in the American south?

Conservatives are still flogging the notion that they hold an innate superiority on national security and foreign policy.

The disaster of Iraq has already stripped the veneer off of that fallacy.

Trying to claim that having military bases in Iraq for 100 years -- when our own intelligence community says "fear of Western domination" is what fuels the "jihadist movement" -- is just like having military bases in our own country, is probably not the best way to regain the public's trust on national security.

MACARONI & CHEESE 1 Lb Elbow

MACARONI & CHEESE

1 Lb Elbow Macaroni
2 8oz Pkgs Shredded Sharp Cheddar Cheese
1 ½ cups Grated Romano
4 cups White (Béchamel) Sauce
Salt & Pepper to taste

WHITE SAUCE

1 Stick Butter
½ cup All Purpose Flour, plus (to make a paste)
2 + cups Warm Milk

Melt butter over medium heat in heavy saucepan. Add enough flour to make a thick pasty mixture. Lower heat a little and add warmed milk a little at a time whisking constantly until mixture thickens again. Mixture should be the consistency of a creamed soup. Set aside to cool.

Cook elbow macaroni until tender. Don’t overcook. Drain. Put cooked elbow macaroni into a 4-quart pan. Add grated cheddar and about 1 cup of the grated Romano cheese. Add salt and pepper to taste then mix in the White sauce. Sprinkle top with more Cheddar and Romano and paprika.

Put pan into 350° oven for about ½ hour or until top is lightly browned. Let cool a little before serving.

I have a cat named Brindel who was limping recently...then I noticed she would switch legs sometimes...I was thinking she was using it to not get picked on by other cats or something...then she one day just stopped limping at all...I couldn't have taken her to the vet anyway because she is the ONE cat in my whole life that I can't pet...She likes the other cats, but not people...She is one of the first I had fixed and taken from the library..Anyway...I've seen a book at the lib. about cats acting sick for attention...but since you are limping too, I believe it's possible she is emulating you since you two are so close...that's my unprofessional opinion...

Also..I've had a kitten with a broken leg before, the doc sets it, but they don't generally cast it because they say kittens will fling around and play no matter what...and it does more damage...but if it's broken I doubt she'd walk on it at all..if it's sprained it should heal on its own in time...

It's the same leg and when she doesn't know I'm looking she is jumping and running and then she limps up to me and I give her all this love and sympathy. I think she is just playing me. Which is totally cool because I'd do the same thing if I had a girlfriend or still lived with my mother or something. She probably hurt it and then noticed that I'm a sucker for the handicapped. 2 cups+ of Milk. When you mix it with the butter and flour it expands, believe me. You can add a bit more milk and let it cook awhile to make more white sauce. It thickens on the heat. If the white sauce gets to thick, you can always add more milk. Just make sure the milk is warm or the sauce will curdle. And you have to wisk it while it's cooking. so the bottom doesn't burn.

Retired Gen. Colin Powell insists he hasn't yet decided who he'll back in the 2008 presidential election.

"I'm looking at all three candidates," Powell said in an exclusive interview with Diane Sawyer for Thursday's "Good Morning America" on ABC. "I know them all very, very well. I consider myself a friend of each and every one of them. And I have not decided who I will vote for yet."

Powell, who served as President Bush's first secretary of state, is a Republican, but that apparently is not enough to sway him toward Sen. John McCain, R-Ariz., the GOP's presumptive nominee.

McCain has staked much of his presidential prospects on the success of the surge strategy in Iraq, a subject of great debate in Washington this week as Gen. David Petraeus took his case to Capitol Hill.

"The United States Armed Forces are very, very stretched. It appears that after the surge is over, we're going to go down to 140,000 troops in Iraq. That's 10,000 more than we had before the surge," Powell observed, reacting to the testimony Petraeus delivered over two days.

"There is something of a continued surge there with that extra 10,000. And based on what Gen. Petraeus has said, he wants to let the surge troops go by July and then take 45 days to see what it looks like, and then begin a process of assessment. Well, that tells me that we know what the administration strategy is going to be through the end of the term of the administration. And that is, we're going to maintain a very significant presence," Powell said.

Extended Presence in Iraq, Trouble in Afghanistan Concern Powell
Powell, who served as chairman of the Joint Chiefs of Staff during the administration of President George H.W. Bush and the first Gulf War, expressed concern over the burden an extended stay in Iraq would put on the troops and the country's military forces.

"It's going to be far more than the 100,000 that Secretary [of Defense Robert] Gates was hoping for. It's going to be like 130,000 or 140,000. That is an extremely difficult burden for the United States Army, the United States Marine Corps, to keep up," Powell told "Good Morning America."
