Obama Team Counting Senate Votes on Eric Holder as Attorney General

President-elect Barack Obama's aides have privately asked senators whether Washington attorney Eric Holder would be confirmed as the next attorney general, according to a person involved in the talks.

The talks suggest that Obama is deeply interested in Holder, who served as the No. 2 official in the Justice Department under President Clinton.

In the past week, Obama aides have asked Senate Republicans whether they would support Holder. In particular, the aides questioned whether Holder's confirmation would be delayed because of his involvement in the 2001 pardon of fugitive Marc Rich by President Bill Clinton.

Newsweek, quoting unidentified legal sources close to the presidential transition team, reported Tuesday that Obama offered Holder the job and he accepted. Newsweek said Holder still has to undergo a formal "vetting" review by the Obama transition team before the selection is final.

One person involved in the talks told The Associated Press that the Obama team has received some assurances that, while the Rich pardon would certainly come up during hearings, the nomination likely wouldn't be held up over that. The person spoke on condition of anonymity to describe the private conversations.

I think we all have bptsd. I personally am having a hard time trusting what any politician says because we have been so systematically lied to and deceived that it is hard to imagine that anyone in that club can tell the truth.

I also have a wait and see attitude, but sometimes I get triggered like today with Lie Berman, and then hearing about the non prosecution of torture. Sam cleared this up for me a bit but still it is easy to throw up my hands and say, "see, they are all alike damnit!"

I also had a rough day with work which does not help. 2 no shows. Subsequent boredom and worry. It all goes together. And then to top it off Sam calls me mappenhow again :)

I think he has a lysdexia problem....

There's an update in the vote counting for the Alaska Senate race and it's great news for Mark Begich:

Begich: 146,286

Stevens: 143,912

The difference is now 2,374 votes. That's up from 1,022 I believe, and good for a percentage lead of 0.77%. The number of votes remaining to be counted is small which makes it unlikely Stevens can close the gap.

Obama won’t investigate terror interrogators

Barack Obama’s incoming administration is unlikely to bring criminal charges against government officials who authorized or engaged in harsh interrogations of suspected terrorists during the George W. Bush presidency.

Obama, who has criticized the use of torture, is being urged by some constitutional scholars and human rights groups to investigate possible war crimes by the Bush administration.

Two Obama advisers said there’s little — if any — chance that the incoming president’s Justice Department will go after anyone involved in authorizing or carrying out interrogations that provoked worldwide outrage.

Obama has committed to reviewing interrogations on al-Qaida and other terror suspects. After he takes office in January, Obama is expected to create a panel modeled after the 9/11 Commission to study interrogations, including those using waterboarding and other tactics that critics call torture. The panel’s findings would be used to ensure that future interrogations are undisputedly legal.

Asked this weekend during a Vermont Public Radio interview if Bush administration officials would face war crimes, Senate Judiciary Chairman Patrick Leahy flatly said, "In the United States, no."

"These things are not going to happen," said Leahy, D-Vt.

Robert Litt, a former top Clinton administration Justice Department prosecutor, said Obama should focus on moving forward with anti-torture policy instead of looking back.

"Both for policy and political reasons, it would not be beneficial to spend a lot of time hauling people up before Congress or before grand juries and going over what went on," Litt said at a Brookings Institution discussion about Obama's legal policy. "To as great of an extent we can say, the last eight years are over, now we can move forward — that would be beneficial both to the country and the president, politically."

Alaska and Minnesota were not only the safer bets for Democratic wins, but the ones we could do the least about.

What the Dems and Obama need to put all of their resources into is the Georgia race. With Obama having overwhelmingly won the election, that is sure to heat up as the date nears. The more national media light that shines on that race, the more it will favor the Democrats in terms of enthusiasm for turnout and we know who has the better ground game at this point.

WASHINGTON (CNN) -- Democrat-turned-independent Sen. Joe Lieberman managed to keep his Senate committee chairmanship in part because President-elect Barack Obama didn't want to punish him for supporting Sen. John McCain, Lieberman said Tuesday.

The Senate Democratic caucus, following a lengthy and often heated debate, voted 42-13 Tuesday to let Lieberman continue chairing the Senate Homeland Security Committee.

The caucus did, however, strip Lieberman of his spot on the Environment and Public Works Committee.

A Democrat in the Senate for 18 years before going independent, Lieberman criticized Obama, the Democratic nominee, during the race for the White House.

"I know that my colleagues in the Senate Democratic caucus were moved not only that Sen. [Harry] Reid said about my longtime record, but by the appeal from President-elect Obama himself that the nation unite now to confront our very serious problems," Lieberman said in the Capitol as those colleagues nodded in agreement behind him.

Democrats were angered by Lieberman's speech to the Republican National Convention, where he praised his longtime friend McCain and criticized Obama for not reaching across the aisle to work with Republicans during his time in the Senate

It's not just the few rejected absentee ballots, that's just part of the canvassing for errors since the election. They are going to recount the whole state, including tens of thousands of undervotes. Undervotes are when the optical scanner registered no vote for either candidate, for whatever reason. Since most undervotes are cast by the poor, less educated and new voters who are not familiar with the process, they all have a heavy Democratic lean, hence Franken's probable win.

Really? Aside from Alice, ToniD, Sunshine Jim, Crank Bait and Air Ono, I got no support from you guys.

They took the time to actually write me. some of them even sent me ten or twenty bucks. (which was/is greatly appreciated). Ono actually sent me 50! (which eclipsed the combined total of the others)

Anyway, my point, poorly made, is that one can't single one out without ignoring others.

Today, Senate Democrats showed us that disloyalty and trashing the Democratic agenda have no consequences. Joe Lieberman was rewarded for his bad behavior.

Next up, House Majority Leader Steny Hoyer.

Using the coded language of the right wing, Hoyer said today that Democrats in Congress aren't really going to be Democrats:
As the House prepares to elect its leaders, House Majority Leader Steny Hoyer is challenging the idea that the expanded Democratic majority and its leaders will make a hard left turn.

“For the first time in decades, we are a true national majority party—and if we want to stay that way, we must govern like one,” Hoyer (D-Md.) is to say in a speech today at the National Press Club, according to excerpts of his remarks obtained by The Hill.
Hoyer did, in fact, deliver this speech today at the Press Club. But, he wanted the message out in advance that he'd be trashing the left, which is why his office gave it to The Hill in advance.

Hoyer, as usual, has it all wrong. If Democrats want to stay in power, they need to enact the agenda of change for which people voted. The Democrats need to actually lead, something Democrats often seem incapable of doing. Instead, too many Democrats, like Hoyer, undermine the progressive agenda every step of the way. The biggest problem we're going to have this year won't be from Republicans. One of their leaders, Eric Cantor, told the Washington Times the GOP is irrelevant:

"Where we have really fallen down is, we have lacked the ability to be relevant to people's lives. Let's set aside the last eight years, and our falling down in living up to expectations of what we said we were going to do," Mr. Cantor told The Washington Times in his district office outside of Richmond. "It's the relevancy question."
Cantor is right.

So, the biggest obstacles to change will be Democrats like Hoyer who will undermine the agenda that the American people think they're getting from President Obama. The corporate-backed Democrats prefer pablum and inaction. And, we've already seen that Senate Democrats are spineless. The Democrats on Capitol Hill are going to be their own worst enemies.

Sen. Edward M. Kennedy (D-Mass.), making his second appearance on Capitol Hill since he began treatment for a malignant brain tumor in June, told reporters yesterday that he would advance a bill early next year calling for universal health care.

Some Democrats, including members of President-elect Barack Obama's circle, have begun to view expanded coverage as a longer-term goal.

The brief appearance by Kennedy, who made a surprise return in July to vote on a Medicare bill, represented an opportunity for him to show colleagues that he remains energetic and engaged, and that he intends to reclaim his committee post in January and take charge of the Obama health-care agenda. Some Democrats had speculated that Sen. Hillary Rodham Clinton (D-N.Y.) would attempt to assume the chairmanship of the Senate Health, Education, Labor and Pensions Committee.

Senate Finance Committee Chairman Max Baucus (D-Mont.) rolled out his own health-care bill days after Obama was elected, and Sen. Ron Wyden (D-Ore.) also expects to be a leading participant in the effort to establish universal health care.
